THE OFFICE OF RESEARCH & DEVELOPMENT (ORD)

Legal Bases

The Office of Research and Development (ORD) is the university’s implementation arm for its research function. It commits to fostering a research culture within and beyond the university and would support its vision, mission, goals, and objectives. The said office must follow the Philippine Constitution and other legal frameworks.

 

Philippine Constitution (1987)

Section 5.1. The State shall consider regional and sectoral needs and conditions and encourage local planning in developing educational policies and programs.

Section 5.2. Academic freedom shall be enjoyed in all institutions of higher learning.

Section 10. Science and technology are essential for national development and progress. Therefore, the State shall prioritize research and development, invention, innovation, and utilization, and science and technology education, training, and services. Furthermore, it shall support indigenous, appropriate, and self-reliant scientific and technological capabilities and their application to the country’s productive systems and national life.

 

RA 2067 (Science Act of 1958)

Section 2. In consonance with the provisions of section four, Article XIV of the Constitution, it is now declared to be the state’s policy to promote scientific and technological research and development, foster invention, and utilize scientific knowledge as an effective instrument for the promotion of national progress.

Section 3. In the implementation of the preceding policy, the Government shall, under the provisions of this Act:

(1) Stimulate and guide scientific, engineering, and technological efforts toward filling the primary and immediate needs of the people;

(2) Survey the scientific, engineering, and technological resources of the country and formulate a comprehensive program for the development and maximum utilization of such resources in the solution of the country’s problems;

(3) Strengthen the educational system of the country so that the same will provide a steady source of competent scientific and technological human resources;

(4) Furnish incentives to the private and individual initiatives in scientific work as a fundamental basis for the advancement of science;

(5) Promote and encourage the dissemination of the results of scientific and technological research and the general application thereof;

(6) Encourage and facilitate the active participation of domestic and foreign sectors in furnishing financial, technical, and other forms of assistance for scientific and technological activities;

(7) Promote coordination and cooperation in research in order to secure concentration of effort, minimize duplication and thereby achieve maximum progress;

(8) Initiate and bring about the establishment of standards, quality control measures, and documentation facilities; and

(9) Encourage studies in the pure and fundamental sciences.

 

RA 8292 (Higher Education Modernization Act of 1997)

Section 2. Declaration of Policy. “The State shall likewise ensure and protect academic freedom and promote its exercise and observance for the continuing intellectual growth, the advancement of learning and research … State-supported institutions of higher learning shall gear their programs to national, regional or local development plan ….”

 

RA 8439 (Magna Carta for Scientists, Engineers, Researchers and other S & T Personnel in the Government of 1997)

Section 2. Declaration of Policy. The State recognizes science and technology as essential for national development and progress. To attain this objective, it is with this declared the policy of the State to provide for a program of human resources development in science and technology to achieve and maintain the necessary reservoir of talent and human resources that will sustain its drive for fundamental science and technology mastery.

The State shall establish, promote and support programs leading to the realization of this objective, such as science and engineering scholarship programs, improvement of the quality of science and engineering education, popularization of science culture, and provision of incentives for pursuing careers in science and technology.

 

RA 9311 (The Eastern Visayas State University Charter of 2004)

Section 2. General Mandate. “The University … shall undertake research and extension services and provide progressive leadership in its areas of specialization.”

Section 3. Curricular Offerings. “The University shall offer undergraduate, graduate, and short-term technical courses within its areas of specialization and according to its capabilities…….to carry out its objectives, particularly to meet the needs of the Province of Leyte and the Eastern Visayas Region.”

Article 10. Section 450. Magna Carta for Scientists, Engineers, Researchers, and Other S&T Personnel of the University. The entitlement by the officials or officers, faculty members, and employees of the University of the Magna Carta for Scientists, Engineers, Researchers, and Other S&T Personnel in Government shall be subject to the qualifications, requirements, and processes under Republic Act No. 8439 and its IRR.
